Rules for Buyers

GENERAL AUCTION INFO

These are AS IS, Where Is, Auctions with No Arbitration or recourse.
"AS IS" means the buyer accepts the vehicle with all existing faults and damages, and "WHERE IS" means the buyer is responsible for vehicle removal from its current location.
The Sellers may offer an inspection period where buyers are welcome to review the cars in person. If available, days and times can be found on the vehicle listing.
Vehicle availability and description are subject to change without prior notice.
Vehicles may be removed from auction without notice, usually because the owner recovered the vehicle.
It is ultimately the buyer's responsibility to review the vehicle and judge the vehicle's condition before bidding.
Any defects noted are not intended to be exhaustive and are limited to observations at the moment. If you buy it, and it does not start, there will not be a refund. Bid accordingly.

RULES

All bidders must be registered and approved online prior to bidding.
Bidding on any vehicle is confirmation of acceptance of all these rules
New buyers may be limited to one winning bid until their 1st purchase is paid for and picked up.
It is the buyers' responsibility to read the sellers' specific terms and conditions found on the vehicle details.
The sale information is not guaranteed to be correct. Bidders rely solely on their own observations, inspections, and evaluations in determining whether to buy a vehicle.
The buyer is responsible for all registration fees And any state legal requirements before registration.
The buyer is responsible for sales and local tax, if applicable.
Vehicles may be subject to a buyer fee, which can differ depending on the seller and or auction type. Please consult the vehicle listing for the seller's conditions and specific fee guidelines. Prior to placing a bid, we recommend clicking the “What are the fees and policies'' link for the specific vehicle you intend to bid on.
All sales are final. No refunds and no returns, unless agreed to in writing by the seller.
Vehicles must be paid and removed by 3 PM, no later than 2 business days after the auction.
These auction vehicles are usually law enforcement impounds, accidents, dealer trade-ins, and stored vehicles. Often the seller has no way to determine how the vehicle drives. If the seller lists that the vehicle starts, it is not a guarantee it will start again.
If you cannot pick up your vehicle within 2 business days, contact the seller immediately to make special arrangements. Important: Due to space limitations, most sellers cannot extend the pickup date.
Vehicles are sold as is, where is, and must be purchased in their current condition and picked up from their current location unless prior arrangements are made with the seller directly.
Upon payment for the vehicle, it is essential to promptly remove the vehicle from the auction site to avoid potential storage fees.
Most sellers accept cash, cashier’s check, money order, and credit cards.
Paying with a credit or debit card may result in a fee, check the seller's policies for details.
If you have any questions about the policies of the seller, contact the seller directly for the fastest results.

OTHER CONSIDERATIONS

No maintenance or repairs are allowed on the premises.
The presence of locksmiths is strictly prohibited.
Installing fuel or batteries is strictly forbidden.
In the event the vehicle fails to start, the buyer must arrange for a towing service.
The seller may offer towing at a fixed-rate, which maybe requested during checkout.
Any towing company seeking to retrieve a vehicle from the seller's location must have adequate general liability and worker's compensation coverage. Furthermore, the company is required to provide a hold harmless agreement on official letterhead. A loading fee might be applied if loading is necessary. Please discuss loading procedures during checkout with the seller.

IMPORTANT VEHICLE NOTES

Vehicle listings, with the term TMU, indicate the True Mileage is Unknown.
TMU or zero mileage listed on the vehicle, usually means the odometer cannot be read or is inoperable.

Auction Simplified By Traxero, is the software provider, not the auction. And as such are not responsible for loss or damage to vehicles that are not immediately paid for and removed from the property.
Auction Simplified By Traxero, hereby disclaims and excludes any and all warranties of title, including without limitation that the title is good, and its transfer is rightful, and that the vehicle is delivered free from any security interest or other lien or encumbrance.
Auction Simplified By Traxero also disclaims and excludes any and all warranties that the vehicle is delivered free from any rightful claim of any third party by way of infringement or the like.
All vehicles are sold “AS-IS, WHERE IS, WITH ALL FAULTS”. Auction Simplified By Traxero hereby disclaims and excludes any and all implied warranties, including without limitation the implied warranties of merchantability and fitness for a particular purpose.

Notwithstanding the above Terms and Conditions, in any exception; the sole and exclusive remedy for breach of contract of warranty or any other reason shall be return of the vehicle and repayment of the purchase price. Under no circumstance shall Auction Simplified By Traxero be liable for consequential or incidental damage; including but not limited to repairs, improvements, loss of use, and DMV/Registration fees.

These are “AS-IS, WHERE IS, WITH ALL FAULTS” Auctions. It is ultimately the buyer’s responsibility to review and judge vehicle condition before bidding. When in doubt, contact the seller before bidding.
